Fixed origination market under consultation


On 18 May 2017, ANACOM approved a draft decision on the wholesale market for call origination on the public telephone network provided at a fixed location - definition of product markets and geographic markets, assessments of market power (SMP) and imposition, maintenance, amendment or withdrawal of regulatory obligations (former Market 2 of Recommendation 2007/879/EC).

According to the analysis, only the wholesale market for call origination on the public telephone network provided at a fixed location enabling retail services, supported by indirect access, is subject to ex ante regulation.

MEO - Serviços de Comunicações e Multimédia has SMP in this market, and is therefore made subject to a range of ex ante regulatory obligations, including:

  • obligation to respond to reasonable requests for access;
  • non-discrimination;
  • transparency in the publication of information;
  • price controls (cost-oriented);
  • separation of accounts and cost accounting.

This draft decision was submitted to a prior hearing of interested parties, in accordance with the Código de Procedimento Administrativo (Administrative Proceeding Code), and also to the general consultation procedure established under Article 8 of Lei das Comunicações Eletrónicas (Electronic Communications Lawhttps://www.anacom.pt/render.jsp?contentId=975162). A period of 30 working days was given to interested parties to express their views; as such comments (in writing and in Portuguese) are to be submitted no later than 5 July 2017, sent by email to mercado-originacao@anacom.ptmailto:mercado-originacao@anacom.pt1.

Once the consultation process has been concluded, the contributions received will be made public. Therefore, for the purposes of publication on this website, interested parties should also submit a non-confidential version of their responses, excluding any items considered confidential.
