Annual net neutrality report


By decision of 29 June 2017, ANACOM has approved the report on the application of articles 3 and 4 of Regulation (EU) 2015/2120 of the European Parliament and of the Council of 25 November 2015 (TMS Regulation) during the period from 30 April 2016 to 30 April 2017; this corresponds to the first twelve months of application of the general provisions of this Regulation on net neutrality.

In accordance with the TSM Regulation, national regulatory authorities are required to publish annual reports on their monitoring and findings as regards these articles and respective conclusions, submitting these reports to the European Commission and to the Body of European Regulators for Electronic Communications (BEREC).

Within this framework, ANACOM sent requests to MEO - Serviços de Comunicações e Multimédia, NOS Comunicações and companies of the Group, NOWO Communications and Vodafone Portugal - Comunicações Pessoais, to gather information that would allow a more detailed analysis of how the TSM Regulation is being implemented - in particular, as regards the characteristics of the Internet access offers and traffic management practices of these providers (fixed broadband and mobile broadband access).

The present report was prepared based on the providers' responses and on additional information gathered by ANACOM, analysing implementation of the TSM Regulation and highlighting the conditions associated with Internet access services and the activities developed by ANACOM within the scope of the Regulation.

On the same date, this report was also sent to the EC and BEREC.
