Criteria governing the formulation of universal postal service pricing - discontinuation of procedure


By determination of 1 August 2014, ANACOM has decided to discontinue, without need to adjudicate, the procedure to which the draft decision on the criteria governing the formulation of universal postal service pricing (approved by determination of 29 July 2013) was submitted.

This decision follows the publication of Decree-Law no. 160/2013 of 19 November, which amended Lei Postal (Postal Law) and the Bases da Concessão do serviço postal universal (Universal postal service concession bases).

Two of the amendments enacted by this Law affect the regime governing the pricing of the universal postal service:

  • adoption of a three-year minimum period during which the criteria governing the formulation of universal service pricing, as defined by ANACOM (paragraph 3 of article 14 of the Postal Law) are to apply;
     
  • modification of the scope of application of paragraph 3 of article 14, excluding its application to special pricing, for which a specific price regime is defined in article 14a (this amendment follows the repeal of paragraph 2 of article 14 and the addition of article 14a).

Notwithstanding, the report on the prior hearing and public consultation to which the draft decision was submitted, following this determination, has been prepared and approved.

ANACOM decided to make this report available on its website, together with the opinion of ANACOM's Advisory Council and the comments received during the consultation procedure.

On the same date, ANACOM approved a new draft decision on the criteria governing the formulation of universal postal service pricing.
