8.1. Amendment of portability regulation and specification


Following approval, on 27 October 2011, of a draft regulation amending the Portability Regulation1, Regulation no. 114/2012 was published on 13 March 2012.

With the new regulation, the maximum period of one working day following a request by a subscriber for the effective transfer of their number was mandated, except in the following cases: i) when the subscriber has requested or has agreed to a longer period, ii) in the case of Multiple Subscriber Number (MSN) and Direct Dialling In (DDI) portability entailing an active configuration request from the recipient provider to the donor provider, where the subscriber has no knowledge of said configuration; iii) where the operation of switching provider, associated with the portability, entails physical intervention on the network that supports the service to be provided or where access to this network is not available; and iv) when the services for which portability is required are sold using distance contracts or door-to-door sales.

As a result of amendments to Portability Regulation, it became necessary to amend the Portability Specification; this was approved by ICP-ANACOM Determination of 30 April 2012, after meetings held with all providers with portability responsibilities who saw fit to attend, as well as with the reference entity.

The amended Portability Regulation and Portability Specification entered into force on 13 September 2012.
