13.6. Fixed Wireless Access (FWA)


Following a request from WTS - Redes e Serviços de Telecomunicações, S.A. (WTS) of 16 December 2011 to revoke the right of use of frequencies to which it holds title, by determination of 9 February 2012, ICP-ANACOM approved the revocation of the right of use of frequencies held by the company (Right of use of frequencies ICP-ANACOM no. 10/2006 - FWA) for the operation of FWA systems, together with radio licence 504 400 associated with this right of use, with effect from 31 December 2012.

On 25 September 2012, Optimus notified ICP-ANACOM that, as from 31 December 2012, it did not intend to continue using the frequencies whose rights of use were allocated to the company for operation of the fixed wireless access service (FWA).

By determination of 13 December, ICP-ANACOM decided to repeal the act of allocating the right of use of frequencies for the operation of FWA systems held by Optimus and consequently, the supporting title granted to the company (ICP-ANACOM no. 08/2006 - FWA), effective 31 December 2012. Similarly, it was decided to revoke radio licence no. 504 240, to which Optimus held title, in the context of the provision of FWA pursuant to Right of use ICP-ANACOM no. 08/2006.

OniTelecom - Infocomunicações, S.A. (Onitelecom) holds title to Right of use ICP-ANACOM no. 6/2006, issued on November 23, 2006, which authorises use of a block of 2x56 MHz, corresponding to the 24.549 GHz-24.605 GHz and 25.557 GHz-25.613 GHz frequency bands for FWA systems in geographical areas 1, 2 and 9 as defined in Administrative Rule No. 1062/2004 of 24 August.

Following the determination of 15 April 2011, approving phased discontinuation of the FWA network, in 2012, Onitelecom sought to amend Right of Use ICP-ANACOM no. 6/2006, as regards the number of stations installed and, therefore, sought to amend the corresponding radio network licence. By determination of 29 May 2013, ICP-ANACOM approved amendment of the right of use for the operation of FWA systems held by Onitelecom - Infocomunicações, S.A., and consequently the supporting title (ICP-ANACOM no. 06/2006 - FWA), and radio licence no. 504 242, associated with this right of use. This Decision took effect from 12 December 2012.

Vodafone holds title to Right of Use ICP-ANACOM no. 9/2006, issued on 23 November 2006, for the operation of FWA systems. Towards the end of 2012, Vodafone requested revocation of this title with effect from April 2014 and sought revision of the commitment enshrined therein, in particular as regards the number of central stations installed, and therefore, amendment of the corresponding radio network licence. By determination of 15 February 2013, ICP-ANACOM approved the amendment of the right of use for the operation of FWA systems held by Vodafone Portugal - Comunicações Pessoais, S.A., and, as a result, the supporting title (ICP-ANACOM no. 09/2006 - FWA), and radio licence no. 504 740, associated with this right of use.
