In terms of regulatory activities, the following measures were published in 2001:

1.1 ICP-initiated activities

General Telecommunications Regime:

  • Alteration of the Regulation on the Operation and Management of Public Telecommunications Networks - Decree-Law no. 249/2001 of 21 September;
  • Postponement of the deadline to start licensed operations for IMT2000/UMTS to 31 December 2002 - Order no. 111/MES/2001 of 24 October 2001;
  • Modification of the Regulation on the public tender to award four IMT2000/UMTS licenses, approved by Administrative Rule 532-A/2000 of 31 July - Administrative Rule 1428-A/2001 of 17 December;

Radiocommunications:

  • Fees to be applied to radiocommunications - Administrative Rule no. 667-A/2001 of 2 July, corrected by Rectification Declaration no. 14-E/2001 of 31 July;
  • Categorising stations that need radio licenses, situations of exemption from network or station licenses, guidelines for the award of radio licenses and requirements for the respective technical projects - Notice published in the Diário da República (Series III) on 18 September 2001.

Terminal Equipment:

  • Divulgation of references to common technical standards and regulations, under terms of Decree-Law no. 192/2000 of 18 August - publication of various notices in Series III of Diário da República.

Digital Television:

  • Regulation on the public tender for awarding a license to establish, operate and manage a platform for digital terrestrial television - Administrative Rule no. 346-A/2001 of 6  April;
  • Launching of a public tender - Notice no. 5520-A/2001 (2nd Series), 7 April, published in the Diário da República (Series II Supplement) on 7 April 2001;

Conditional Access:

Postal Services:

  • Regime for access to and operation as a postal service provider in a competitive environment - Decree-Law no. 150/2001 of 7 May;
  • Setting of tariffs by licensed and authorised postal service providers - Infrastructure Ministry Order no. 21080/2001 (2nd Series) of 21 September, published in the Diário da República (Series II) on 10 October 2001;
  • Universal Postal Service Price Convention, signed by the DGCC, ICP and CTT on 21 December 2000 and published in the Diário da República (Series III) on 1 March 2001;
  • Quality Convention for Universal Postal Service - signed by the ICP and CTT on 21 December 2000 and published in the Diário da República (Series III) on 1 March 2001;
  • Supplement to the Universal Postal Service Price Convention, signed by the DGCC, ICP and CTT on 21 December 2001 (not published in the Diário da República for 2001);

ITED:

  • Approval of criteria that comply with paragraphs c) and d) of section 3 of article 23, approval of the certificate of conformity model to be issued by the certifying entities, as well as steps referred to in section 2 of article 42, and all of Decree-Law no. 59/2000 of 19 April - Notice published in the Diário da República (Series III) on 28 April 2001.

  • Establishment of accreditation criteria for entities that offer degrees in basic information technology skills, for the model and criteria for issuance of same, and other associated formalities and requirements - Administrative Rule no. 1013/2001 of 21 August;
  • Evaluation of Internet sites that belong to entities that are directly or indirectly part of government administration - Council of Ministers Resolution no. 22/2001 of 27 February;
  • Creation of an Internet site where job offers in public administration are published, as well as a site for job offers in the science and technology field - Council of Ministers Resolution no. 24/2001 of 1 March;
  • Support to public administration workers towards the purchase of computers and other IT equipment - Council of Ministers Resolution no. 25/2001 of 1 March;
  • Rules on the donation of IT equipment by central administrative entities, during the process of installing new or updating existing equipment - Decree-Law no. 153/2001 of 7 May;
  • Diploma for Basic Information Technology Skills - Decree-Law no. 140/2001 of 24 April;
  • Approval of a rule for employers that have 10 or more employees to declare their salaries in digital format, or via the Internet, to the social security system services - Decree-Law no. 106/2001 of 6 April;
  • Divulgation and public discussion of the experts' report on the electronic acquisition of goods and services by public administration. This was decided by a working committee that was put together in the wake of approval of Council of Ministers Resolution no. 143/2000 of 27 September - Council of Ministers Resolution no. 32/2001 (2nd Series) of 2 March;
  • Steps taken towards creation of a government portal, as well as rules on maintaining and updating the site - Council of Ministers Resolution no. 138/2001 of 30 August;
  • New system of government incentives for the media - Decree-Law no. 56/2001 of 19 February, corrected by Rectification Declaration no. 4-B/2001 of 28 February;
  • Candidacies for the incentives set out in Decree-Law no. 56/2001 of 19 February, Administrative Rule no. 204/2001 of 14 March;
  • Minimum prices for subscriptions to periodic publications, for those entities that want to take part in paid postal services - Administrative Rule no. 225/2001 of 19 March.

Telecommunications Infrastructure in Buildings:

  • Modifications to legal regulations on urbanisation and edification - Decree-Law no. 177/2001 of 4 July;
  • Instruction on prior receipt of information, reception of licensing and authorisation for all types of town planning projects - Administrative Rule no. 1110/2001 of 19 September;
  • Manual on licensed and authorised projects - Administrative Rule no. 1109/2001of 19 September;
  • In 2000, annual update of the legal regulations to be observed and executed by technicians responsible for projects - Administrative Rule no. 1104/2001 of 17 September.

  • New Radio Law - Law no. 4/2001 of 23 February;
  • Modification of Decree-Law no. 175/99 of 21 May, containing the regulation on audiotext advertising - Decree-Law no. 148/2001 of 7 May;
  • First modification of Decree-Law no. 177/99 of 21 May, establishes rules and regulations for audiotext service providers, of Decree-Law no. 474/99 of 8 November, concerning approval of the Regulation for the Operation and Management of Fixed Telephone Service and Management, and to Decree-Law no. 175/99 of 21 May, which regulates advertising on audiotext services - Law no. 95/2001 of 20 August;
