Dispute between TV Cabo and competing operators


Following a request submitted by TV Cabo, ANACOM approved a draft decision on the settlement of a dispute between this company and other cable TV distribution operators - Bragatel, Cabovisão, Pluricanal Leiria, Pluricanal Santarém and TVTEL – concerning prospecting practices of the latter towards customers, as well as their action on infrastructure owned by TV Cabo to disconnect services provided by this company.

According to this draft decision, adopted on 24 May 2007, the request for dispute settlement submitted by TV Cabo is rejected, on the grounds that compliance with obligations arising from applicable law (Electronic Communications Law) is not at issue, as facts that involve an effective dispute related to compliance with these obligations were not put forward, nor were they evidenced.

Moreover, it was decided to recommend operators that they should inform customers who wish to change operators of the need to comply with contractual clauses on termination of contracts, namely how and when to submit the notice of termination. It is also recommended that operators under consideration reach an agreement on appropriate procedures to disconnect and activate services and to dismantle existent infrastructures, in order to avoid situations which may affect the integrity of cable distribution networks, as well as consumer interests.

This determination was submitted to the prior hearing of interested parties, pursuant to the Code of Administrative Procedure, TV Cabo, Bragatel, Cabovisão, Pluricanal Leiria, Pluricanal Santarém and TVTEL having been granted a ten-working-day deadline to provide their views on the subject.
