Telephone directories and information services within the universal service


ANACOM has given its approval to a raft of measures on the format and conditions governing the supply of relevant information on the respective subscribers who have made a favourable indication as to the inclusion of their personal data in telephone directories and information services within the scope of the universal service of electronic communications.
 
In particular, this determination of 24 May 2007 determines to Optimus and PT Comunicações (PTC) and to Vodafone Portugal and PTC that, within a period of not more than 30 days, they shall take necessary steps in order to reach an agreement on this matter under the terms and for the purposes of the provisions of article 39 of the Electronic Communications Law (Law no. 5/2004 of 10 February). It is further determined that these companies shall, within the same period, submit copies of such agreements to ANACOM. In the event that these companies fail to reach an agreement, they shall notify ANACOM of such failure, providing detail and evidence of the steps taken, the obstacles encountered and their positions as to how such obstacles to agreement might be surmounted. Accordingly ANACOM may determine the format and conditions by which such information might be made available to the universal service provider.
 
It is further recommended that PTC take special care in order to ensure that information transmitted in this context is not used for any other purpose.
 
The report on the prior hearing, to which the corresponding draft decision, approved on 29 March, was submitted, forms an integral part of this determination.
