Pre-selection services - undue terminations by PTC


On 8 March 2007, ANACOM approved a decision on undue terminations by PT Comunicações (PTC) of pre-selection services, following repeated complaints by some operators – Vodafone, OniTelecom and Tele2 – relatively to an alleged misconduct on the part of PTC as regards pre-selection termination procedures started by pre-selected customers.
 
This decision determines that PTC must immediately cease pre-selection deactivations which are not based on a request conveyed by the pre-selected provided, following the respective contract amendment or termination between the subscriber and this provider, so as to comply with the pre-selection deactivation procedure provided for in article 10 of the Selection and Pre-Selection Regulation (Regulation no. 1/2006, of 9 January).
 
PTC has also been requested to remove from its website all information on pre-selection termination procedures in its current form, within at the most 5 working days, and to provide such data according to the referred provision of the above-mentioned Regulation.
 
This determination integrates the report of the prior hearing on the corresponding draft decision, approved by determination of 18 January 2007.
