Conditions for the deployment of Local Loop Unbundling (LLU)


By determination of 8 November 2005, approval was granted to the decision on the conditions for the deployment of the local loop unbundling (LLU), under which PT Comunicações, S.A., must accordingly modify its Reference Unbundling Offer (RUO) within a 10-day time limit, in order to ensure the protection of interests of end users and the strengthening of the appropriate conditions for market competition, namely through the establishment of compensation for non-compliance.

Among other aspects, is has been determined that, where the final client is without service for more than 30 minutes during or immediately after the loop unbundling process, or the porting of the number and the loop unbundling do not occur in the same agreed time frame, for reasons for which PTC or a company sub-contracted by PTC is responsible, this company shall compensate the operator or service provider with € 38 and with one twenty-fourth (1/24) of this amount for each additional hour passing (with business hours and non-business hours being counted) when the service is not available or until the loop unbundling or the porting of the number occurs, where they do not occur in the same agreed time frame.

Moreover, this determination establishes upon PTC the obligation to submit to ICP-ANACOM a quarterly report on the levels of quality provided in the scope of the RUO and the compensation amounts incurred.

This determination integrates the report of the prior hearing of interested parties on the corresponding draft decision, approved on 8 July 2005. This report includes the assessment of comments received in the scope of the prior hearing from the following entities: Vodafone Portugal, PT Comunicações, Onitelecom, Sonaecom and Telemilénio.
