Access to national TV channels in Madeira


A protocol was signed on 6th August 2004 allowing free access to the non-conditioned access four generalist channels available in the Mainland in Madeira Autonomous Region - currently, RTP1, 2, SIC and TVI.  The protocol also foresees gradual migration from analogue to digital technology.

At present, the citizens in Madeira Autonomous Region only have access, in open signal, to channel 1 and RTP regional channel.

In accordance with the assumed commitments, Cable TV Madeira (CTVM) shall give free access, from its cable network and TV Cabo Portugal satellite platform, to the generalist channels and to the RTP/Madeira regional channel as well as to a programme disclosure service (Mosaic channel).

Applying to the option attached to this protocol consisting of the acquisition and installation of digital terminal equipment, the programme contained in Annexe I was established to materialize the foreseen actions.  In this context, one sole contribution is defined – 50€ – applicable to each citizen benefiting from this programme, that is, the owners of housing in Madeira archipelago, being or not subscribers of CTVM.  The Republic and Regional Governments shall finance the remaining cost. CTVM undertook that prices for the acquisition and installation of associated equipment will not have any profit margin.

This programme shall be in force as from a 30-day period after the signature of the protocol. Therefore, the requests for benefits shall start being received by CTVM as from 6 September, the installation of equipment starting on 6 November 2004.

The protocol involved the Republic and Regional Governments represented respectively by the Minister of State and Presidency Nuno Morais Sarmento and by the Regional Government President, Alberto João Jardim, CTVM and ANACOM, represented by its Presidents, José Pereira Gouveia and Álvaro Dâmaso.

In its capacity as regulatory authority, ANACOM shall participate in the application of the approved solution, following-up and supervising the execution of the agreement. They will also determine, every six months, the amounts to be financed and to compensate under the foreseen terms, based, namely, on the information system that CTVM shall create, containing all the relevant information on the programme implementation. Simultaneously, ANACOM shall ensure that non-confidential information contained in this information system is made available to the operators that may operate in the Madeira Autonomous Region.

The protocol also foresees the application of contractual fines whenever programme implementation and citizens’ guarantees are jeopardized, which amount shall be fixed by ANACOM within a previously defined limit.
