Meeting of EWG on Phase II Article 7 (BEREC) - Bucharest


The expert working group (EWG) on article 7 a) of the Framework Directive (Phase II) met last 17 April in Bucharest. Its mission is to assess the validity of the serious doubts raised by the European Commission (EC) regarding the remedies Germany's Bundesnetzagentur (BNetzA) regulator wants to apply in the market for fixed termination in the Deutsche Telekom network. BNetzA specifically proposes charging wholesale prices based on the long run incremental costs (LRIC+) model. As occurred recently with mobile terminations in the same country, the EC's serious doubts concern whether the measure proposed by BNetzA is compatible with community law and with safeguarding the European internal market.

The group's rapporteur, with whom an expert posted by ANACOM collaborates, is the representative from Romania's regulator, ANCOM. The group's findings must be ready by mid-May and once approved will comprise the BEREC opinion issued under article 7 a) of the Framework Directive concerning the draft measure in question.
