ANACOM reduces costs of universal service provision by 16%


ANACOM has approved the final values of the CLSU - custos líquidos do serviço universal (net costs of the universal service obligation) for the 2007/2009 period. Following two audits of the values submitted by PT Comunicações and a decision by ANACOM, ordering a number of corrections to the submitted values, the final amount corresponding to the net costs of the universal service obligation was cut to 66.8 million euros (a reduction of 16% compared to the value initially presented by PT Comunicações, 79.6 million euros).

This reduction of 12.8 million euros from the value initially presented by PTC results from determinations imposed by ANACOM following the audits which were performed in order to ensure that the defined methodology was properly followed.

With this decision, ANACOM has concluded the procedure of calculating the net costs of the universal service obligation for the 2007/2009 period, serving as basis to compensate the operator providing the service.

The next steps are to be taken by PTC, which pursuant to the CLSU financing law (Law 35/2012) is required to apply to the Government for compensation of these costs within a period not exceeding five days following notification of ICP-ANACOM's final decision.

Compensation will be provided using the Compensation Fund, to which companies offering publicly available electronic communication services or networks are required to contribute in the event that, in the present case, they have reported eligible turnover comprising not less than 1% of overall turnover in the sector in the year in which the costs are approved.

It is incumbent upon ANACOM to initiate the procedure to identify the companies called on to contribute to the fund which, under the terms of the law, occurs in the third quarter of the year following approval of the CLSU.
