Quality of service indicators - ANACOM denies CTT request to deduct records affected by employee strike of June 2013


On 3 October 2013, ANACOM approved the final decision rejecting the request presented by CTT - Correios de Portugal seeking to deduct records covering the sending of correio normal (non-priority mail) and correio azul (priority mail) directly impacted by the strike held by CTT staff on 7 June 2013. The deduction had been requested for the purposes of calculating the quality of service indicators (QSI) defined pursuant to paragraph 5 of article 6 of the Convénio de Qualidade (Quality Convention) of the universal postal service.

ANACOM took the view that the situation cited by CTT - the strike held by company employees on 7 June 2013, - did not constitute a situation of force majeure or a phenomenon as taking place and evolving clearly outside CTT's control.  In addition, the strike occurred after the full liberalisation of the postal sector in Portugal.  As such the strike is not deemed relevant for the purposes of consideration with regard to the deduction mechanism provided for in paragraphs 1 and 3 of article 6 of the Convénio de Qualidade (Quality Convention).
