Final decision on the price charged by PT Comunicações in context of DTT (MUX A)


By determination of 2 May 2014, ANACOM has approved the final decision on the price charged by PT Comunicações (PTC) for the encoding, multiplexing, transport and broadcast of free unrestricted access television channels by the digital terrestrial network (DTT) (MUX A). This determination responds to the request for action submitted to ANACOM by Rádio e Televisão de Portugal (RTP) seeking immediate mediation in determining the price charged by PTC for these services.

In this respect, ANACOM decided to terminate the corresponding procedure and decided, on this occasion, not to intervene in the review of the pricing in question.

This decision takes into account:

  • the existence of contracts between PTC and television operators, including RTP;
     
  • the fact that it cannot be unequivocally concluded that the price is excessive;
     
  • the fact that, on the question of whether there is any abuse of dominant position by PTC, the competent authority for this purpose has not identified any circumstance which calls on it to intervene, at least not on an immediate basis, and has instead decided to wait for the present procedure to conclude before making an assessment on whether to take action in accordance with its remit.

ANACOM will reassess this question as appropriate in the context of the launched public consultation and thorough investigation into the costs of DTT services provided by PTC. This process has already begun, and may also serve as an input to the market analysis covering the DTT service, on which ANACOM will take a decision in due course.
