Protocol amending the regional Agreement
for the european broadcasting area
(Stockholm, 1961)
Preamble
The undersigned Delegates of the Administrations of:
Federal Republic of Germany, Austria, Byelorussian Soviet Socialist Republic, Vatican City State, Denmark, Arab Republic of Egypt, Spain, Finland, France, Greece, Hungarian People's Republic, Ireland, State of Israel, Italy, Luxembourg, Republic of Malta, Monaco, Norway, Kingdom of the Netherlands, People's Republic of Poland, Portugal, German Democratic Republic, Ukrainian Soviet Socialist Republic, Socialist Republic of Romania, United Kingdom of Great Britain and Northern Ireland, Republic of San Marino, Sweden, Confederation of Switzerland, Czechoslovak Socialist Republic, Tunisia, Turkey, Union of Soviet Socialist Republics, Socialist Federal Republic of Yugoslavia,
meeting in Geneva for a Regional Administrative Conference of the Members of the Union in the European Broadcasting Area, convened in conformity with Article 63 in connection with Article 62 of the International Telecommunication Convention (Nairobi, 1982),
mindful of Article 8 of the Regional Agreement for the European Broadcasting Area (Stockholm, 1961),
having considered Resolution No. 5 of the Regional Administrative Conference for the Planning of VHF Sound Broadcasting (Region I and Part of Region 3) (Geneva, 1984),
have adopted, subject to the approval of their Administrations, the following provisions relating to the revision of certain parts of the Regional Agreement for the European Broadcasting Area (Stockholm, 1961) and contained in the present Protocol.
Article I
Definitions
For the purposes of the present Protocol, the following terms shall have the meanings defined below:
1.1 - Union: The International Telecommunication Union.
1.2 - Secretary-General: The Secretary-General of the Union.
1.3 - Convention: The International Telecommunication Convention (Nairobi, 1982).
1.4 - European Broadcasting Area: The area designated as such in No. 404 of the Radio Regulations (Geneva, 1979), i.e.:
The "European Broadcasting Area" is bounded on the west by the western boundary of Region 1, on the east by the meridian 40º East of Greenwich and on the south by the parallel 30º North so as to include the western part of the USSR, the northern part of Saudi Arabia and that part of those countries bordering the Mediterranean within these limits. In addition, Iraq and Jordan are included in the European Broadcasting Area.
1.5 - Agreement (1961): The Regional Agreement for the European Broadcasting Area (Stockholm, 1961) concerning the use of Frequencies by the Broadcasting Service in the VHF and UHF bands.
1.6 - Protocol: The present Protocol amending the Agreement (1961), by revising certain parts thereof.
1.7 - Regional Agreement (1984): The Regional Agreement Relating to the Use of the Band 87.5 - 108 MHz for FM Sound Broadcasting (Region I and Part of Region 3) (Geneva, 1984).
1.8 - Administration: Any governmental department or service responsible for discharging the obligations undertaken in the Convention and the Regulations.
1.9 - Party to the Agreement (1961): Any Member of the Union in the European Broadcasting Area having approved or acceded to the Agreement (1961).
Article 2
Revision of certain parts of the Agreement (1961)
2.1 - The following parts of the Agreement (1961) relating to sound broadcasting in the band 87.5 - 100 MHz shall be revised as follows:
Article 1.
ADD 9A Regional Agreement (1984): The agreement relating to the use of the band 87.5 - 108 MHz for FM sound broadcasting (Region I and part of Region 3) adopted by the Regional Administrative Conference (Geneva, 1984).
Article 4:
ADD 21A 1.1.2A When the change concerns a station in the band 87.5 - 100 MHz, consultations shall also be carried out with an administration whose assignment in conformity with the Regional Agreement (1984) is considered affected by the proposed change. For this purpose the criteria of Annex 2 to the Regional Agreement (1984), as well as the coordination distances given in Chapter I of Annex 4 to that Agreement, shall be applied.
MOD 28 - 1.4 The IFRB shall publish the information in a special section of its weekly circular, specifying the proposed change is the result of consultation carried out under the provisions of sub-paragraphs 1.1.1, 1.1.2, 1.1.2A and 1.1.3 above, or that it is being effected under the provisions of paragraph 1.2 above.
ADD 35A - 3.2A - If a change, although made in accordance with the provisions of Section I above, causes harmful interference to an assignment in conformity with the Regional Agreement (1984), the Administration which has made the change shall take the requisite action to eliminate such interference.
Annex 2 Chapter 1:
MOD 8 Modulation of sound transmissions
The maximum frequency deviation of F3 emissions, unless otherwise specified in the Plans, shall not exceed ± 50 kc/s. If modulation frequencies higher than 15 kc/s are used, the maximum frequency deviation may have to be reduced in order to avoid harmful interference to stations working on adjacent channels.
Annex 2, Chapter 2:
SUP - plan for sound broadcasting stations in the frequency band 87.5 - 100 Mc/s (pages 47-122 of the Agreement (1961))
Annex 2, Chapter 3, Section 2:
MOD - Read "D - Germany (Federal Republic of)"
MOD - Read "DDR(1) - German Democratic Republic" (1) for "D-D (1) - Eastern Germany"; consequently any reference, in Column 4 in the Plans for television stations, to "D-D" shall read "DDR".
Article 3
Entry into force of the Protocol
3.1 - The Protocol shall enter into force on 1 July 1987, at 0001 hours UTC, i.e. the date of the entry into force of the Regional Agreement (1984).
Article 4
Approval of the Protocol
4.1 - Any Member of the Union in the European Broadcasting Area who is a Party to the Agreement (1961) and a signatory of the Protocol shall notify its approval of the Protocol, as soon as possible and, in any event, prior to its entry into force (I July 1987, at 0001 hours UTC), to the Secretary-General, who shall at once inform the other Members of the Union. The Secretary-General is authorized to take, at any time, any appropriate action aimed at the timely implementation of the provisions of the present paragraph.
4.2 - Any other Member of the Union in the European Broadcasting Area signatory of the Protocol may notify its approval of the latter to the Secretary-General, who shall at once inform the other Members of the Union, it being understood that such approval shall also imply the approval of, or accession to, the Agreement (1961).
Article 5
Accession to the Protocol
5.1 - Any Member of the Union in the European Broadcasting Area who is a Party to the Agreement (1961), but not a signatory of the Protocol, should accede to the latter as soon as possible and to deposit, in any event prior to the entry into force of the Protocol (I July 1987, at 0001 hours UTC), an instrument of accession with the Secretary-General, who shall at once inform the other Members of the Union. The Secretary-General is authorized to take, at any time, any appropriate action aimed at the timely implementation of the provisions of the present paragraph.
5.2 - Accession to the Protocol shall be made without reservation and shall become effective on the date on which the instrument of accession is received by the Secretary-General.
Article 6
Approval of or Accession to the Agreement (1961)
6.1 - Any Member of the Union in the European Broadcasting Area approving or acceding to the Agreement (1961) after the adoption of the Protocol shall be considered as also approving or acceding to the Protocol.
Article 7
Revision of the Protocol
7.1 - The Protocol shall not be revised except by a competent administrative radio conference which is convened in accordance with the procedure laid down in the Convention and to which at least all the Members of the Union in the European Broadcasting Area shall be invited.

IN WITNESS WHEREOF, the undersigned Delegates of the Members of the Union in the European Broadcasting Area mentioned below have, on behalf of the competent authorities of their respective countries, signed this Protocol in a single copy in the Arabic, English, French, Russian and Spanish languages; in case of dispute, the French text shall be authentic. This copy shall remain deposited in the archives of the Union. The Secretary-General shall forward one certified true copy to each Member of the Union in the European Broadcasting Area.

Final Protocol
At the time of signing the Final Acts of the Regional Administrative Conference of the Members of the Union in the European Broadcasting Area to revise certain parts of the Stockholm Agreement (1961) (Geneva, August 1985), the undersigned delegates take note of the following statement.

For the Union of Soviet Socialist Republics:
In signing the Final Acts, the Union of Soviet Socialist Republics hereby states that it reserves the right to take the necessary measures to protect its television broadcasts in the 87.5 - 100 MHz band if it should prove impossible to reach agreement with the other administrations concerned in a spirit of international cooperation and mutual understanding, in accordance with the International Telecommunication Convention.
