On 22 March 2016, ANACOM decided to suspend use of the access codes "68954" and "68955" allocated to Euro da Sorte, a provider of message-based valued added services, and has given the company a period of 10 working days to adopt corrective measures. The suspension remains in force until notification of a decision by ANACOM recognising adoption of the measures ordered.
This urgent decision follows the detection of irregularities in the provision of message-based valued added services, with strong evidence that this company has not been obtaining confirmation from users as to their request for the service prior to instructing the support provider of message-based valued added services. This constitutes a breach of the obligation to observe the conditions and restrictions inherent in the respective access as under point a) of paragraph 2 of Article 6, taking into account, in particular, the provisions of Article 9a of Decree-Law no. 177/99 of 21 May, and constitutes harm to users.
This decision has been notified to MEO - Serviços de Comunicações e Multimédia, as operator supporting the service, in order to block access to the codes "68954" and "68955". The decision was also reported to Ministério Público (Public Prosecutor), Ministério da Administração Interna (Ministry of the Internal Administration), Direção-Geral do Consumidor (Directorate General for the Consumer) and Comissão Nacional de Proteção de Dados (National Data Protection Commission).
