ANACOM approves decision on dispute between MEO and Vodafone regarding non-compliance with RPAO procedures


On 2 August 2018, ANACOM approved the final decision on the request for intervention to resolve a dispute between MEO - Serviços de Comunicações e Multimédia (MEO) and Vodafone Portugal - Comunicações Pessoais (Vodafone) over non-compliance with procedures set out and governed by the Reference Poles Access Offer (RPAO), specifically as regards the installation of customer drops.

Following the analysis made, ANACOM took the view that, since there had been no amendments to version 3.1 of the current RPAO, there is no basis for Vodafone to unilaterally cease payment of amounts related to the occupation of MEO's poles, associated with installed customer drops, countering the conduct which it had adopted, of its own accord, up until the end of July/beginning of August 2017.

As such, ANACOM decided to order Vodafone to ensure immediate compliance with the rules set out in version 3.1 of the RPAO as regards procedures governing the installation of customer drops, ceasing its current practice, and as a consequence:

  • submit requests for the installation of customers drops to MEO under the intervention service;
  • inform MEO of all customer drops installed since August 2017 and up to the present date, identifying them correctly in register; and
  • to pay all amounts related to occupation of MEO poles associated with customer drops.

On the same date, approval was given to the report of the prior hearing to which the respective draft decision was submitted (draft decision of 21 June 2018https://www.anacom.pt/render.jsp?contentId=1456661).
