Draft regulation on the registration of postal service providers - public consultation


On 09 August 2018, ANACOM approved a draft regulation on the registration of postal service providers; notice announcing the draft was published on 23 August 2018 in Series II of Diário da República (Official Journal) no. 162/2018 - Notice no. 12035/2018https://www.anacom.pt/render.jsp?contentId=1458628.

Six years subsequent to the entry into force of Lei Postal (Postal Law), and in light of its regulatory and supervisory experience, ANACOM has decided to regulate the procedures governing individual licences, the obligation to provide prior notice of commencement of activity, common duties of reporting and the registration of postal service providers. Under the provisions of the law, this measure is deemed indispensable and necessary to:

  • ensure the updating, simplification and modernisation of the procedures in question;
  • promote consolidated transparency of information as regards market agents; and
  • ensure equal access to the market and freedom to provide postal services, as established in Lei Postal (Postal Lawhttps://www.anacom.pt/render.jsp?contentId=1127982).

Following the recent entry into force of Regulation (EU) 2018/644 of the European Parliament and of the Council of 18 April 2018https://www.anacom.pt/render.jsp?contentId=1435245 on cross-border parcel delivery services, regulation is extended to govern the duty of declaration and the associated reporting obligations referred to in paragraphs  1, 2 and 4-7 of article 4, thereby ensuring articulation between these duties and the reporting obligations which apply to postal service providers.

It was also decided to submit this draft regulation to public consultation, in accordance with article 10 of ANACOM's Statuteshttps://www.anacom.pt/render.jsp?categoryId=333094 and articles 98 et seq. of Código do Procedimento Administrativo (Administrative Proceeding Code) and for the purposes set out in article 9 of Lei Postal (Postal Law).

Interested parties are given a period of 30 working days, from the date of publication in Diário da República (Official Journal), to state their positions. Comments (in writing and in Portuguese) should therefore be submitted no later than 04 October 2018 (sent by email to regulamento.registosp@anacom.ptmailto:regulamento.registosp@anacom.pt1).

Once the consultation process has been concluded, the contributions received will be made public. Therefore, for the purposes of publication on this website, interested parties should also submit a non-confidential version of their responses excluding items considered confidential.
