Public Consultation within the 99 Review (1st stage)

The National Communications Authority (ANACOM) launches today, for a 30-day period, a public consultation on the definition of relevant markets, the assessment of significant market power (SMP), as well as the imposition of obligations to the operators of the several markets of electronic communications.

This consultation, which concerns the new sectorial standards applicable within the new regulatory framework for electronic communications - the so-called 99 Review - aims to gather opinions and additional information of the participants of the several markets regarding certain preliminary options of ICP-ANACOM and related issues, namely, the criteria and indicators used for the definition of relevant markets, the assessment of effective competition, as well as the imposition, maintenance or withdrawal of obligations. Likewise, ANACOM intends to gather information that may be taken into consideration in the course of the subsequent process of market analysis.

The time limit for receipt of comments shall be 30 June 2003. Responses shall be submitted preferably by e-mail to the address analise.mercados@anacom.pt.

The new regulatory framework for communications comprises 5 Directives, in addition to Decisions, Recommendations and Guidelines.

Based on the most recent methodologies of European competition law and on the principle of technological neutrality, the 99 Review ?package? shall be applied by the fifteen European Union Member States as from 25 July 2003.
