Having analyzed European Commission's comments, received pursuant to article 7, paragraph 3, of Directive 2002/21/EC, ANACOM approved by determination of 14 January 2009, a final decision on the definition of the product and geographic markets, SMP assessment and the imposition, maintenance, alteration or suppression of regulatory obligations with respect to the markets for wholesale (physical) network infrastructure access at a fixed location and wholesale broadband access.
Compared to the version notified to EC, this decision clarifies that optic fibre access is included in the range of relevant markets and introduces in tables 34 and 35 the possibility of imposing, under specific conditions, a wholesale optic loop provision in the wholesale broadband access market, as well as a reference to the monitoring of competitive conditions in ''C areas'', prior to the expiry of a transitional period of one year.
