By determination of 4 February 2009, ANACOM approved the Regulation amending the Portability Regulation (Regulation no. 58/2005 of 18 August).
Approval was granted also to the report on the final consultation to which this statutory instrument was subject, following determination of 15 October 2008, in the scope of which opinions were received from the following entities: ACOP, DECO, PLURICOOP, DGC, FENACOOP, Onitelecom, Portabil, Portugal Telecom SGPS (on behalf of PTC, TMN, PT Prime and PT Acessos de Internet Wi-Fi), Refertelecom, SGC Telecom SGPS (on behalf of Ar Telecom and WTS), Sonaecom SGPS, UGC, Vodafone Portugal and ZON TV Cabo Portugal.
Taking into account the received comments, amendments were made to article 7 (Obligations of the recipient provider), article 10 (Termination of the agreement), article 12 (Portability order), article 13 (Refusal of an electronic order), article 22 (Publication of information) and 25-A (compensation) of the draft amending Regulation. Article 28 (Temporary provisions) has been repealed, its content having been amended and included under a new article (article 4) of the amending regulation. The consultation report justifies these amendments.
This Regulation will be published in the II Series of the Official Gazette, according to the regulatory procedure defined in ANACOM's Statutes.
