Report on the regulatory approach to next generation access networks


By determination of 18 February 2009, ANACOM approved the public consultation report on the regulatory approach to next generation access networks (NGA).

Taking into account the stage of development of NGA, ANACOM opted to request the market's view on a set of questions, aiming to take the respective responses in account when taking a position on this subject.

The document approved by determination of 18 June 2008 was thus subject to a public consultation, the following bodies having replied: Alcatel-Lucent, APRITEL, Centro de Estudos de Gestão e Economia Aplicada (Faculty of Economics and Management) of the Universidade Católica Portuguesa (Catholic University of Portugal), COLT Telecom, Comissão de Planeamento de Emergência das Comunicações (Emergency Communications Planning Committee) of MOPTC (Ministry for Public Works, Transport and Communications), Ericsson Telecomunicações, Fundação para a Computação Científica Nacional (Foundation for National Scientific Computation), Regional Government of the Azores, Onitelecom, Portugal Telecom SGPS, PT Comunicações, TMN, PT Prime, RTP, SGC Telecom SGPS (on behalf of AR Telecom and WTS), Sonaecom, Vodafone Portugal and ZON Multimédia, SGPS. A response was also received from the financial controller of the Ministry for Public Works, Transport and Communications.

The report now approved joins the analysis of responses received and a summary of ANACOM' principle position as regards the regulatory approach to NGA, which must be understood as a starting point or a guideline, as determinations taken by ANACOM on this matter (as with all others) must comply with consultation procedures defined in Law no. 5/2004 of 10 February and, in some cases, with the requirement of prior notification to the European Commission.
