I/ERG Declaration on the review of the ''telecom package''


During the general assembly of the Independent Regulators Group (IRG) and the plenary session of the European Regulators Group (ERG), held on 26 and 27 February 2009 in Berlin, Germany, a Declaration was adopted on the review of the regulatory framework for electronic communications. In the Declaration, European institutions are urged to reach a fast and effective agreement on the "telecoms package" during the 2nd reading.

I/ERG states that it is of utmost importance to strengthen ERG by fully incorporating it into the regulatory framework, with its role and responsibilities set out in a regulation and reflected in the relevant operative provisions of the Directives.

I/ERG reiterates that it is important to maintain the current regulatory balance which provides sufficient flexibility to allow national regulatory authorities (NRAs) to tailor remedies to overcome the competition problems identified in the national market analysis.

Finally it is underlined that I/ERG is supportive of the political agreement reached in November 2008 by the Council, considering that this agreement strikes a good balance between the need for increased consistency and flexibility for NRAs. Furthermore it formalises and strengthens the role of the system of independent NRAs in the regulatory process.
