Communication from the European Commission on the operating framework for the European Regulatory Agencies


Intending the European Commission to define, along with the European Parliament and the Council, the framework criteria for resource to the European regulatory agencies, it was published, on the 11th of December 2002, the Communication on the general framework of the resource to these agencies.

In times of changes in the communitarian institutions, when it is getting near an European Union enlargement without precedents and in scope of the debate on the European Governance, it was approved, on the 25th of July of 2001, the White Paper on the European Governance.
In order to materialize the recommendations foreseen in this document, some measures have been taken to improve the exercise of the functions and responsibilities of the communitarian institutions, namely, the Communication of the European Commission on ?Better lawmaking?, from 05th of June 2002, and this Communication on the European Regulatory Agencies, whose resource is taken as one of the possibilities of improvement in the execution of the politics and european legislation.

Considering the distinction between executive agencies and regulatory ones, this Communication considers that the european regulatory agencies contribute for the obtaining of a more efficient and strengthened accomplishment of the execution of the communitarian politics, underlining the fact that these same ones have a public service mission. Generally speaking, these agencies may be given tasks that involve only assistance (such as drawing up opinions or studies) and carrying out coordinating checks and inspections at certain operators. In particular, it may be recognized to these agencies their own decision-making powers, being able to adopt individual decisions in a clearly specified area of Community legislation but not legislative measures of general application.

On the other hand use of these agencies is restricted to areas where a single public interest predominates and where they do not have to arbitrate on conflicting public interests, exercise powers of political judgment or make complex economic assessments. These agencies may not be granted responsibilities for which the EC Treaty confers decision-making power directly on the Commission (for example, competition politics area).
