Provision of Public Radio Local Area Networks (R-LAN) access


The European Commission?s Recommendation of 20 March 2003, on the harmonisation of the provision of public R-LAN access to public electronic communications networks and services in the Community, was published in the Official Journal of the European Union (OJEU) on 25 March, 2003.

This Recommendation is pursuant to the new regulatory framework package (99 Revew), particularly the Directive 2002/21/CE of 7 March 2002, on a common regulatory framework for electronic communications networks and services (Framework Directive).  It also considers the Barcelona European Council ?s conclusions, of March 2002, where the fostering of multiple broadband access platforms to the Information Society was advocated, which integrates the eEurope 2005 Action Plan.

Whereas, the Radio Local Area Networks (R-LAN) ? Radio Local Access Networks - provide a wireless broadband access to the Internet and to corporate intranet networks, not only for private uses but also for the public in general, in airports, shopping centers and railroad stations.

Therefore, the Commission recommends all State Members to allow the provision of public R-LAN access to public electronic communications networks and services, in the available 2,4 GHz and 5 GHz bands, to the possible extent, without any sector specific conditions and only subject to general authorization.
