Evaluation of net costs incurred through the provision of universal service


ANACOM  gave approval, on 5 December 2007, to the draft decision on the evaluation of net costs incurred through the provision of the universal service. This follows the presentation by PT Comunicações (PTC) on 12 October of the estimated net costs of universal service (NCUS) in respect of 2003 and a revision of the estimates in respect of 2001 and 2002, and also follows the communication of PTC  of 27 July 2007.

In accordance with this draft decision, ANACOM decided:

(i) That is inappropriate to accept either the NCUS estimates in respect of the 2003 financial period or the revisions to the estimates presented in respect of 2001 and 2002, as set forth in the communication of PTC of 12 October 2006;

(ii) To commence a process of detailed specification in respect of the methodology to be applied in calculation of NCUS and of defining the conditions whereby it could be considered that provision might represent an excessive burden for the respective provider, thereby giving grounds for the establishment of a compensation mechanism. This process would take account of the information available on this issue, including in respect of benchmarking, as well as the specific characteristics of the Portuguese market for the telephone service at a fixed location (FTS) and the process for designating the provider of the universal services (US).

Under the terms of articles 100 and 101 of the Code of Administrative Procedure, these points of the determination now approved were submitted to a prior hearing of PTC, which is given ten days, during which it may submit a written response.

Meanwhile, the conclusions which ANACOM has reached in respect of the issues set out in point (ii) will be submitted to the general consultation procedure as set forth in article 8 of the Law of Electronic Communications (LEC), within a period not exceeding 90 days.
