Wholesale markets of voice call termination on individual mobile networks - public consultations


ANACOM launches yesterday, for a 30-working-day-period, two public consultations regarding the wholesale markets of voice call termination on individual mobile networks (market 16), one of them concerning the definition of product markets and geographic markets, the assessment of significant market power (SMP) and the imposition, maintenance, amendment or withdraw of regulatory obligations, and the other regarding the obligation of price control. The Authority aims at defining and analyzing competition in these markets, at declaring undertakings with SMP and at determining the appropriate regulatory obligations (remedies). These consultations, which integrate the corresponding draft decisions of ANACOM, were approved by determination of 21 December.

The process which comprises the market definition and the analysis of competition therein has already been the purpose of a preliminary public consultation launched on 6 April 2004 (integrated in the  3rd stage/template15.jsp?categoryId=108419) and undertakings have already been requested to provide the quantitative information necessary to the procedures in course, namely by means of a questionnaire launched for this purpose.

The Competition Authority was notified to present an opinion on the matter, pursuant to article 61 of Law no. 5/2004 of 10 February, and likewise the specific consultation procedure was activated on the draft decision now approved, which concerns the definition of product markets and geographic markets, assessment of SMP and the imposition, maintenance, amendment or withdraw of regulatory obligations, as regards the European Commission and the national regulatory authorities (NRA) of the remaining Member States.

The deadline for the reception of observations of interested parties is the 7 of February 2005. Responses shall be sent, preferably by email, to the address terminacao.movel@anacom.pt.
