ANACOM opinion on AdC proceedings on access to the postal network of CTT


By decision of 27 June 2018, ANACOM has approved an opinion on the draft final decision of AdC - Autoridade da Concorrência (Portuguese Competition Authority) to archive, due to fulfilment of conditions, the administrative proceedings brought against CTT - Correios de Portugal (CTT).

These proceedings stem from a complaint made to AdC by VASP Premium - Entrega Personalizada de Publicações in November 2014, alleging refusal by CTT to grant access to its postal distribution network.

In formulating its opinion, ANACOM took the position that the undertakings presented by CTT represent an extension of the conditions governing the current offer of access to the postal network of CTT, which has been in force since 15 February 2016; however, there has been an observable lack of interest in the new offer of CTT (on the terms proposed), and it may not, therefore, have any effective impact in terms of increasing competition.

ANACOM also considers that further possibilities for providing access to CTT's network remain available, and it will therefore continue to exercise all powers of regulation, supervision, oversight and enforcement under the powers and responsibilities assigned to it, in particular as under article 38 of Lei Postal (Postal Law)https://www.anacom.pt/render.jsp?categoryId=346264.
