By determination of 8 July 2009, ANACOM approved the Regulation amending Regulation no. 58/2005, published on 18 August (Portability Regulation), as amended by Regulation no. 87/2009, published on 18 February. The amendment now adopted aims to clarify the means of calculating the time limits as well as its compatibility with provisions in Annex II of the Portability Specifications.
Approval was given also to the report on the consultation to which that statutory instrument was subject, in the scope of the regulatory consultation procedure and the general consultation procedure, which were decided by determination of 15 April 2009, in the scope of which comments were received from the following bodies: Associação Portuguesa para a Defesa do Consumidor; Cabovisão; Direcção-Geral do Consumidor; Federação Nacional das Cooperativas de Consumidores; Grupo PT (Portugal Telecom SGPS, PT Comunicações, PT Prime and TMN); Onitelecom; Sonaecom; União Geral de Consumidores; Vodafone Portugal; and ZON TV Cabo Portugal (on its own behalf and on behalf of its affiliates).
Bearing in mind comments received, an amendment was made to paragraph 12 of article 12 of the Portability Regulation, and an article was added to the Amending Regulation, the numbering of which has been altered from a sole article to two articles.
This Regulation will be published in Series II of the Official Gazette, according to the regulatory procedure defined in the Statutes of ANACOM.
