Amendment to the Regulation on Quality of Service


By determination of 19 August 2009, ANACOM approved the Amending Regulation to Regulation on Quality of Service (Regulation no. 46/2005, of 14 June), which applies to companies providing access to the public telephone network at a fixed location and publicly available fixed telephone service.

Approval was given also to the report on the consultation to which this statutory instrument was subject, further to the regulatory consultation procedure and general consultation procedure, ordered by determination of 25 March 2009, in the scope of which comments were received from the following entities: FENACOOP, UGC, ACOP, Direcção-Geral do Consumidor (Consumer Directorate), Ar Telecom, TMN, Onitelecom, PT Comunicações, PT Prime, Sonaecom, Vodafone Portugal and ZON TV Cabo Portugal.

Taking into account comments from respondents, ANACOM decided to maintain overall the draft amendments to Regulation no. 46/2005 which were submitted to consultation; however there are grounds for some changes, with an emphasis on:

(i) Inclusion of standard FTS (fixed telephone service) offers for non-residential customers in the calculation of parameters provided for in the Regulation, the measurement of parameters of quality of service (PQS) and the corresponding data disclosure being performed in separate for both market segments under consideration.

In ANACOM’s view, the disclosure of data on quality of service attached to standard offers for non-residential customers enables the purposes of the Regulation (also provided for in article 40 of the Electronic Communications Law - Law no. 5/2004, of 10 February), concerning the provision to end users of access to comparable, clear, comprehensive and up-to-date information on the quality of service practised by FTS providers, to be more advantageously achieved.


(ii) As regards the measurement of “PQS2 - Fault rate per access line” and “PQS3 - Fault repair time”, the ways in which it applies to FTS offers supported on GSM networks (such as homezoning offers) have been clarified, in order to make procedures related to the calculation of those parameters for such offers more explicit, namely as far as the type of faults considered by these parameters are concerned.


(iii) Removal of the “PQS3 - Fault repair time” breakdown according to the type of faults (“faults of the local access network” and “other faults”), as this change is considered to enable a better understanding of the parameter by end users, to whom where the fault occurs is irrelevant.


This Regulation will be published in Series II of the Official Gazette, according to the regulatory procedure laid down in ANACOM’s statutes.
