ANACOM notifications do not receive any comments by the Commission


The European Commission has analysed, with no comment whatsoever, the notifications submitted by ANACOM, on market assessment, including companies with significant market power (SMP), pursuant to article 57, paragraph no. 1, of Law no. 5/2004, of 10 February (Regicom).

A communication addressed to the Board of Directors of ANACOM reads as follows: ?The Commission has examined the notifications...and has no comments...ANACOM may adopt the resulting draft measures and, where it does so, shall communicate it to the Commission?.

For the first time, since the beginning of this case, a draft measure issued by a national regulatory authority was not subject to any comment by the European Commission.

Those notifications  cover market definitions and significant market power (SMP) declarations regarding the following markets:  market for call origination on the public telephone network provided at a fixed location; and market for call termination on individual public telephone networks provided at a fixed location and fixed telephony wholesale markets (Market for narrowband access to the public telephone network at a fixed location for residential customers and non-residential customers, market for publicly available local and national telephone services provided at a fixed location for residential customers and for non-residential customers, Market for publicly available international telephone services provided at a fixed location for residential customers and for non-residential customers and market for telephone services destined to non-geographic numbers publicly available at a fixed location).

ANACOM is going to submit to internal consultation, at national level, the draft decisions related to the obligations to be imposed to the operators with SMP in the markets in question, for further notification to the Commission.
