Recommendation on Relevant Markets - ''99 Review''


The European Commission has adopted yesterday, 11 February, the Recommendation on relevant product and service markets within the electronic communications sector susceptible to ex ante regulation, pursuant to the framework directive that integrates the new sectorial regulatory package. 

According to this Recommendation, the National Regulatory Authorities (NRA), when defining the relevant markets, should analyse the 18 markets now identified by the Commission in accordance to the competition law principles, which are divided into two great groups: retail markets and wholesale markets. The specific sectorial regulation that will be decided in this context shall become an exception and not a rule.

This Recommendation was the last missing document of the so-called ?99 Review? package. The new sectorial legislation, in force as from 25 July 2003, is characterized by being technological neutral and by fostering service and equipment convergence.

The three main objectives of the new regulatory framework consist in creating a stable and foreseeable regulatory framework, promoting innovation and encouragement to investment in communications networks and services, underlined Erkki Liikanen, European Enterprise and Information Society Commissioner, during the presentation of this Recommendation that took place today, in which also participated Mario Monti, European Competition Commissioner.
